When inside at night with the lights on, a person cannot see outside. The windows reflect and appear black.

Someone inside, however, is in plain, illuminated view from the outside.

A sitting duck, so to speak.

It’s legal to carry a firearm in Texas and just because someone has a firearm in their hand is not justification for the police to kill them. Especially in their own home.

And if the police can’t figure this out then they need to turn in their badges and guns and go find a job where they’re not a threat to law abiding citizens.

As to his claim of self defense let’s turn this around:

Black woman home alone sees someone aiming a weapon at her through her window. She shoots, she scores.

Is that self defense? If yes then the cop cannot claim self defense.

Simply having a firearm in your hand creates a reasonable threat of imminent deadly force and can easily be justification to use deadly force in self-defense. That threat increases when the weapon is aimed in your direction, as happened with Dean.

The woman, likewise, would have a reasonable perception of an imminent deadly threat and she likely would have been justified in shooting Dean especially if she was able to articulate that she saw him draw a weapon. The justification for use of deadly force by one party in an engagement such as this DOES NOT invalidate the same justification for the other party.

Many of us here, I suspect, would arm ourselves if we heard someone sneaking around our yard at night. That's reasonable. In this case it resulted in a tragic situation but not a situation that was reckless or intentional.

She is in her house. He is in her yard. He can have a magical badge and a magical costume and it still does not make it self defense when he goes into her yard and shoots her.

There is a reason he was in her yard and it was a perfectly legitimate reason. He was there on a call and you're making it sound like he just wandered by and started peeking in her window. Dean did nothing illegal, nothing reckless and nothing unreasonable under the circumstances.
