” Andrew High married his Japanese partner in the U.S. and his applications for long-term residence visa in Japan have been denied multiple times. His appeal to the Tokyo High Court is dated Oct. 14.
While the Tokyo District Court upheld the immigration authority’s visa denial, it called out that the authority’s operation was “a violation of Article 14 of the Constitution which guarantees equality under law,” as it grants “designated activity” mid- to long-term residence statuses to same-sex married couples of non-Japanese nationalities but denies the same status to Japanese and foreign same-sex partners who wed overseas.
Attorney Masako Suzuki representing High said following the district court ruling, they proposed to the Tokyo Regional Immigration Services Bureau that the immigration authority consider granting High a residence visa with the “designated activity” status in mind. The Tokyo immigration bureau, however, renewed High’s short-stay visa on Oct. 13 as in the past.
Suzuki said, “Mr. High is feeling helpless and also anger toward the immigration bureau which does not change even after the court called its problems out.”
