Police Harass Innocent Citizens on Their Porch – Lawsuit Filed Today
Posted on August 5, 2022
What you’re about to see here is outrageous body cam footage that has never before been seen by anyone, other than law enforcement. It shows what happened to my clients, Jason Tartt, the property owner and landlord, as well as Donnie and Ventriss Hairston, his innocent and mistreated tenants, on August 7, 2020, when they were subjected to civil rights violations by two deputies with the McDowell County Sheriff’s Office, Dalton Martin and Jordan Horn.
Today we filed a federal civil rights lawsuit, which is posted below. But you can watch the footage for yourself. Before the body cams were turned on, what you need to know is that there was a complaint received that an abandoned church, in an overgrown parcel of land not owned by any of these individuals, apparently had four marijuana plants growing there, among the thick brush. Crime of the century, right? The perpetrators must be one of the elderly African American residents nearby, of course. Instead of treating them as human beings, let’s accuse them first thing, then mistreat, harass, and retaliate against, them if they dare to get uppity, or not know their place.
Donnie and Ventriss Hairston were sitting on the front porch of their rural home, when two deputies approached and began to harass and intimidate them. Their landlord, who lives next door, joined them shortly afterwards and began to ask questions. When they asserted their opinions and rights, retaliation ensued. The landlord, Jason Tartt, was seized and arrested. The Hairstons were shoved into their home against their will. This is never before seen footage, outside of law enforcement of course. Take a look and form your own opinion about what happened.
It wasn’t on their property and it looked like ditch weed (hemp).
The cop was rude to the couple and the landlord who was retired military.
Please try not to be overtly racist.
BTW, I would bet a large sum of money that there is more to this story—there always is.
and i’m sure that’s the reason he dint show up for court... right?
A lot less than there used to be though. Thank God.
It is not a violation to ask for ID. It is a violation to arrest anyone for failing to ID without probable cause.
There are bad attorneys just like there are bad cops.

Says the guy who works at McDonalds. First, I am not familiar with West Virginia law on the subject of providing ID. Second, I know that “the poor black person is the victim” meme always seems to leave out relevant information so, without all of the facts, I keep an open mind. Finally, people who act civilized in their interactions with the police almost never have any issues.
Saw that one a few days ago.
Aside from that one, I also watched a vid of the Loveland CO police dept activities charging people with DUI when they tested negative. Seems that police dept is getting kickbacks from corporations for each DUI they arrest.
Way to go! Back the blue!
Why should anyone with this kind of son of a bitchery going on?
No, he was the owner and the landlord to the couple in his other house—who were also harassed, but not arrested.
Well boy howdy, that explains a lot.
Hemp, Marijuana refer to the same plant but are “etymology” different and birds don’t care. How is a policeman to know the difference unless they have rolling papers.
“Translation: Police doing their job and obstinate minorities getting in the way”
No, I don’t think so. I think you’ve got a couple of soon-to-be-former police officers who made a mountain out of a non-existent molehill.
It is my studied opinion as a burger flipping moron that if I was a lawyer I would defer to the WV lawyer that IS familiar with their laws.
“Aside from that one, I also watched a vid of the Loveland CO police dept activities charging people with DUI when they tested negative.”
The same PD that battered an old, senile woman and fist-bumped about it among themselves. Loveland’s finest.
I think she meant he didn’t own the lot where the weed was found.
Why didn’t the homeowner tell the cops he is a retired Army MP? Mystery.
Ah, yes.
“Why didn’t the homeowner tell the cops he is a retired Army MP? Mystery.”
Why does he need to tell them ANYTHING?
He doesn’t own the property where the weed was and these jackass retards have NO EVIDENCE that he had anything to do with that property.
And now they, their department, and their county will pay. The only thing that remains to be seen is if civil rights charges are brought against the officers.
IMHO they should spend 15-20 for kidnapping.
Ping
The police are allowed to drive up to your house and allowed to ask you if the marijuana growing in your backyard is stuff you are growing.
***********************************
Yes, there are. However, you don’t have to answer.
Plus, it wasn’t even growing in his yard.
You know? I forgot about that!
I had an experience up at Laramie WY around 2013. I was hired as a yard super for a log yard that was an absolute mess and my job was to try and get it cleaned up.
The outfit hired some of the usual riff for logging crews and they all stayed at an old RR station masters house. I had my trailer hooked up and stayed in it.
One, had an heart attack a couple weeks before and had stents put in and got released. He went back to work and proceeded to get his ass drunker than hell there one night.
At just about 2 in the morning there was bang bang bang on my trailer door which about sent me through the GD roof of the thing it scared me so bad.
Got up, put my pants on and answered the door. Right away this punk cop says..”SHOW ME YOUR ID!” I said, “What the hell for?” At that time a EM guy told me that they had a call of a guy who was having chest pains. I said that the only one that could be is the guy through that front door and in the bedroom just ahead. They went in and yup, he was having chest pains.
Anyway. The punk cop started in again and told me that after this, i was required to show ID when it was demanded. One of the other EMs was standing by and I told him to get this cops supervisor here RIGHT NOW! He did, the super came and he and I had a nice long talk.
I explained. Here is how you do this. Knock on the door, when answered, ID yourself as the officer so and so and that there was a call that someone was having a medical problem-chest pains. DO NOT POUND ON THE DOOR AND DEMAND TO SEE ID! I dont have to show this sonny boy ID and there was NO REASON to act like some tough boy just out of academy.
I filed a complaint and the punk was dismissed.
The drunk worker? He was fired the next day by yours truly and sent back to where he came from after they set him straight at the ER..was OK.
Some of these eager beavers need to be taught that common sense and a little respect goes a long way in such incidents.
It wasn’t on their property but “near by”. The cops have no reasonable cause to believe they are growing it. They have no right to ID here. I also don’t believe race has anything to do with it, just bad policing. Cops don’t have the right to demand ID just because there’s weed near by.
