Unfortunately, though your logic is sound, that is not what the 14th says. Specifically:

shall have engaged in insurrection or rebellion against the same,

The real question would be: was it an insurrection?

The DemonRats are driving that point home so as to use the 14th. It is a disgrace what they are doing.
