There is a difference between plain old insanity on the one hand, and legal insanity, on the other. Legal insanity means that you do not appreciate that what you were doing is legally wrong. In this case, the fact that the person hid behind a VPN means that he, she or it knew for a fact that what they were doing was illegal and did not wish to be traced. The insanity defense will not be excepted, if they ever catch this person and charge them.
