Oh, good, Beschloss, maybe you forgot that Plessy was a 7-1 ruling and Dred Scott was 7-2.
Meanwhile, Texas v. Johnson (flag burning) was 5-3 and Lawrence v. Texas (legalized sodomy) was 6-3. Worst of all, for Beschloss' precious "court consensus" theory is that Planned Parenthood v. Casey (so-called "viability test of the humanity of a fetus) was decided 5-4 but on narrow grounds that were otherwise without a majority for the rest of the opinion. The 1992 Casey essentially upheld Roe and cast the issue forward up to today with Dodd..
