In Wisconsin you can be denied release in many violent scenarios. At the top of the list is murder:

969.01 Eligibility for release.
(1) Before conviction. Before conviction, except as provided in ss. 969.035 and 971.14 (1r), a defendant arrested for a criminal offense is eligible for release under reasonable conditions designed to assure his or her appearance in court, protect members of the community from serious bodily harm, or prevent the intimidation of witnesses.

So let’s look at 969.035:

969.035 Pretrial detention; denial of release from custody.
(1) In this section, “violent crime” means any crime specified in s. 940.01, 940.02, 940.03, 940.05, 940.06, 940.07, 940.08, 940.10, 940.19 (5), 940.195 (5), 940.198 (2) (a) or (c), 940.21, 940.225 (1), 940.23, 941.327, 948.02 (1) or (2), 948.025, 948.03, or 948.085.

So let’s look at 940.01 and 940.02 at the top of the list:

CRIMES AGAINST LIFE AND BODILY SECURITY

LIFE
940.01 First-degree intentional homicide.
940.02 First-degree reckless homicide.
940.03 Felony murder.

Hmmm.... Interesting.

Thank you for doing the leg work.

Do you remember the tragedy in Waukesha, WI. last November? Darrell Brooks piloted his SUV through the annual Christmas parade, intentionally striking as many people as he could, killing 6 and injuring 60.

At the time he was jailed and held on $5,000,000 bail.

Many questioned why he wasn’t held on remand and the answer came in published reports in the media that Wisconsin didn’t allow remand and that bail/bond must be allowed. And that, the press reported, was bail was set so high.

So, I (we) were lied to by the press.

I’m shocked.
