Federal Judge Allows Lawsuit Challenging GOP Rep. Greene’s Re-Election Bid

An Obama-appointed federal judge has allowed a liberal lawsuit aimed at disqualifying Georgia GOP Rep. Marjorie Taylor Greene from running for re-election over her role at the U.S. Capitol last January.

“The challenge to Greene’s candidacy was mounted by a group of five voters from her congressional district who argued she is ineligible to run for federal office under a provision of the 14th Amendment that was ratified after the Civil War and meant to keep former Confederate officers and officials from holding public office again,” CBS News reported.

“In a challenge filed with Georgia Secretary of State Brad Raffensperger in late March, the voters argued Greene voluntarily aided and engaged in the January 6 insurrection to obstruct the peaceful transfer of power, thereby disqualifying her from serving as a member of Congress under the constitutional provision,” the report continued.

“Greene asked a federal court in Atlanta to intervene in the effort from the group of voters, seeking a preliminary injunction and temporary restraining order. But Judge Amy Totenberg of U.S. District Court for the Northern District of Georgia rebuffed Greene’s request, finding she failed to establish a strong likelihood of success on the legal merits of the case,” the report added.

“This case involves a whirlpool of colliding constitutional interests of public import,” Totenberg wrote in her 73-page decision.

“The novelty of the factual and historical posture of this case — especially when assessed in the context of a preliminary injunction motion reviewed on a fast track — has made resolution of the complex legal issues at stake here particularly demanding,” the judge added.

James Bopp Jr., Greene’s attorney, has dismissed the lawsuit against his client as “50 pages of newspaper articles, hearsay, and political hyperbole.”

Bopp also warned during the court hearing last week that a ruling against Green could eventually lead to challenges against Donald Trump’s fitness for office.

Greene spoke out against the lawsuit earlier this month.

“This is the same evil playbook the dishonest Communist Democrats use against President Trump and his family. Now they are using it on me, because they know I’m effective and will not bow to the DC machine,” Greene said.

“As I’ve said many times before, I’m vehemently opposed to all forms of political violence,” she said. “I’ve never encouraged political violence and never will.”

The Tennessee GOP has voted to remove three candidates who were vying for a seat representing the state’s 5th Congressional District.

Republicans voted to boot Morgan Ortagus, Robby Starbuck, and Baxter Lee from the primary ballot, Tennessee Republican Chairman Scott Golden told news outlets.

Golden and the party did not respond to requests for more information.

Ortagus, a State Department spokeswoman during the Trump administration, was recently endorsed by former President Donald Trump.

Starbuck, a filmmaker who used to live in California, has promoted Trump policies such as strong border enforcement.

Lee is a businessman who has described himself as a conservative outsider.

The vote came after state lawmakers passed legislation that requires congressional candidates to have voted in three previous statewide general elections.

But Tennessee Gov. Bill Lee, a Republican, returned the legislation to lawmakers without his signature.

The legislation will still become law but it will not apply to the 2022 election, the Tennessee Secretary of State’s Office told news outlets.

“We feel the voters are best able to determine who should represent them in Congress,” a spokesperson for Lee told outlets.

Candidates removed from the ballot offered similar arguments.

“I believe that voters in Middle Tennessee should pick their representative—not establishment party insiders,” Ortagus said in a statement obtained by The Epoch Times. “Our team is evaluating the options before us.”

Starbuck said in March that he’s only been registered with one party before and has only donated to GOP candidates.

“Not allowing me on the ballot would disenfranchise a huge segment of our voters in Tennessee, discourage people from engaging in the process and most of all it would reek of the dirty politics that makes so many distrust our elections,” he said at the time.

On Wednesday, Starbuck said: “Sadly in Tennessee candidates are NOT elected, they’re SELECTED by a tiny group of establishment RINO hacks. We’ll fight this with every ounce of fight we have. They declared war on TN voters yesterday. It’s not about me, it’s about YOU and I’ll fight for your right to vote.”

Lee did not respond to a request for comment.

Ortagus and Starbuck both moved to Tennessee in recent years.

The seat they hope to win is currently held by Rep. Jim Cooper (D-Tenn.). Cooper is retiring at the end of his current term.

A lawsuit was filed against the legislation that would affect future candidates in federal court after it was passed.

Three residents who say they planned to vote for Ortagus alleged the bill violates the U.S. Constitution, which requires that members of Congress be 25 or older, have been a citizen of the United States for seven years, and must live in the state they’re representing when they’re elected.

“Plaintiffs seek damages and a declaration that the provision is unconstitutional so that all qualified candidates who wish to run for Congress in the August 4, 2022 primary election may do so,” the suit stated.

I just glanced through the article and it looks accurate as far as I can remember. A few weeks ago Zelensky banned all news outlets other than the official Ukraine gov news, and banned all political parties other than the one he belongs to.

On Intel Slava I’ve read of assassinations of Ukrainians that were suspected of various things; primarily not toeing the line. No opposition is allowed.

This is simply legal harrassment. There was no insurrection. Since she has not been convicted or charged of insurrection, since Nobody has been charged or convicted of these things it needs to be dismissed.

BTW I listened to the snip of interview with frmr Act. Sec Def.Chris Miller and I have some thoughts about it. Until later.

Emerald Robinson interview with Gen.Flynn, topic Ukraine/Russia. I’m listening, so far he’s criticizing those sending more arms/munition etc to Ukraine; now he’s pointing out NATO encroachment onto Russia bordering countries and Ukraine trying to enter NATO and the EU and they don’t qualify, esp. the deep level of corruption in Ukraine. So this is a good interview.
