I think you’re missing a very important point:
If it’s known/proven that there was a foreign element to the election fraud, then the case is clear that it’s an act of war, and we don’t have a legitimate government. In that event, the military could absolutely take over to protect the country from the foreigners. It’s what they do when you think about it.
Think of it this way, if say China hacked our election systems and was able to make it look like their guy wins when he didn’t, there is nothing unconstitutional about righting that wrong. There is no functional difference between invading and seizing Washington DC with your military in planes and tanks, and doing the same via computer manipulation. The military is the only way.
And what many are overlooking is that the Kenyan issued an E.O. that declared our elections as part of national critical infrastructure. Trump reapproved/extended, with modifications, the E.O.
Thus foreign and domestic attacks that led to the fraudulent results of elections were/are considered attacks on critical national infrastructure, our election systems. This could activate the military per Trump’s and the Kenyan’s E.O.
On July 23, 2018 General Nakasone, the head of NSA and U.S. Cyber Command:
.....Nakasone said a cyber attack from another government on U.S. critical infrastructure would cross the threshold into war and we would definitely respond.
The U.S. government’s definition of critical infrastructure expanded in January 2017 when the Department of Homeland Security put election systems in that category.
What Trump was telling us in that introduction to the Strategy, was that they were forced to implement something like devolution, because our enemies were engaging us in the cyber world. He was telling us they hacked the election.

Plus the war we are in is not the typical type of war from history but one fought in cyber space a cyber war.
My concern is optics. If the removal of an illegitimate government is successfully repulsed by a plurality of the American people or a split in the military, the problem becomes exponentially worse.
LJ’s points are also well taken. Fewer and fewer people believe the lies spewed by the Mainstream Media. But we haven’t hit the tipping point yet. That won’t happen until two MSM venues change course and start reporting the truth.
I have hopes next month for CNN’s new management which has pledged a change of direction. But CNN could be isolated by the six MSM companies just as easily as they isolated OAN. You need someone as big as CBS to change sides.
The announcement that we have an illegitimate government has to come from a source that’s both neutral and believable. Anything else will simply be labeled a conspiracy theory. The other MSM outlets will create hysteria by raising the specter of fascism and “the end of our democracy.” Antifa and BLM will hit the streets, armed to the teeth, ripping our cities apart with the connivance of the media and political leaders. Those who get their news primarily from MSM outlets will not believe the truth. We’d be lining up sides for a Second Civil War.
(Frankly I’d be happy to see Antifa and BLM rounded up, but the optics would be fodder for the MSM. I’d be even happier to see MSM outlets shut down, but that would reek of banana republic tactics. Optics are important.)
As to the question of military intervention, I would pose the question, “Which military?” We have two militaries today.
The Perfumed Princes of the Pentagon aren’t going to back anything that would interrupt their careers, their cushy retirements and the flow of Deep State money into their bank accounts. We’re talking about officers of lesser rank bypassing the chain of command to execute a successful mutiny against the top brass. We haven’t had a successful mutiny since the adoption of the Constitution.
Do we send a squad of MP’s, Green Berets or Marines into the Pentagon to arrest the Perfumed Princes and rendition them to Gitmo? Do we hand them pistols and tell them to do their duty? What if the Perfumed Princes succeed in getting parts of the military to resist? The threat here is a military-versus-military conflict augmenting a possible Second Civil War. I hesitate to think that a Perfumed Prince might find a way to short-circuit the protocols for using WMDs.
In addition to the legal conditions you’ve brought up, on the optics side we need a clear majority of the people. We need conditions to be bad enough for people to cheer the military, the belief that in fact we’re being governed by an illegitimate government, and enough of the MSM to either support it or stay neutral.
(The “ten days darkness” Q post is intriguing. If you shut down communications, you remove the MSM factor and make it impossible for resistance to organize.)
Like most of us, I’m trying to peer behind the curtain to see how this will all play out.
