There is plenty of legal basis for prosecution, by tribunal or otherwise.

This was used for the bases of the Nuremberg Trials, so in fact the US signed on to Nuremberg. President Harry S Truman appointed Associate Supreme Court Justice Robert H Jackson to be the chief prosecutor representing the United States in the proposed trials for the European Axis powers. So again the US takes legal action to activate the Nuremberg Trials.
