Will I Be Arrested After a Self-Defense Incident?
Will you be arrested after a self-defense incident? Why are some people arrested immediately, some people arrested weeks or months later, and some people never arrested? The Armed Attorneys break down what you need to know about arrest after self-defense.
The SMARTEST thing one can do after a self-defense incident is hope it happened in RED County/City/State.
That specific formula virtually guarantees a criminal prosecution.
I know that you think it’s pithy, but it’s stupid.
“Will you be arrested after a self-defense incident? Why are some people arrested immediately, some people arrested weeks or months later, and some people never arrested?”
Arrested? In Jail?
A: YOU TALKED TO THE POLICE
” anything you.. USED AGAINST YOU”
Not FOR you.
GET a LWAYER. NEVER TALK TO THE POLICE.
Law Abiding Gun Owner
That's who I have.
I have insurance and lawyer coverage under USCCA. So the main points are to tell them I have been the victim of a crime. There are people here that need medical attention. That's it. I will cooperate fully after consulting with my attorney. Period. You don't give them anything. If the local prosecutor has it in for pro 2A types, he/she may try to build a case against you. Give them nothing to work with. The criminals' families may try to build a civil lawsuit against you, given them nothing to work with.
Make coming after you in any way an entirely uphill battle. For example, if there are no witnesses other than yourself. (eg. the perpetrator was wounded fatally) Then there may be no case to be made. Any rounds recovered must be matched to your firearm. If the rounds have expanded as JHP's tend to do, or been otherwise significantly deformed... A match may be impossible or imperfect. Then even if the prosecutor doesn't believe your story of self defense, their case is entirely circumstantial - as long as you admit nothing. There are no guarantees, you may end up in jail for saving your own life. But you don't make it in any way any easier for them to do it to you.
Assume you will be.
Homicide (actual or attempted) is illegal everywhere.
Exceptions apply, but it’s largely for a judge to sort out the details - cops are there to just apprehend suspects and evidence. Police _might_ evaluate it and decide it’s obvious that reasonable exceptions apply, but if there’s _any_ doubt thereof they’ll stick you in a cage until a judge decides to let you out.
When I took my CCP classes, our instructor told us, flat out, yes you will be arrested. Yes, you will be questioned. Yes, get an attorney before you answer any questions.
DON'T LOOK LIKE FOOD.
Pay attention. Lift weights. Train in combatives. Let you outward appearance reflect "If you f--k with me, I will not only end you, I will drive to your house and kill everything and everyone you hold dear. Then I'll go home and have a steak."
Well, you and I aren’t going to be Rittenhoused.
This may be true now but soon, when THE PEOPLE have had enough of this baloney, we will rise up and defend ourselves and there will be so many of us that they will not be able to go after all of us. I keep reading all the stories of those being attacked and think, if they had a weapon and used it the criminals would soon be gone and we would no longer need the jails. (unless dems put conservatives and any dissenting voice in them to silence us.)
The answer is ZERO.
Better to have it and not need it, than to not have it and need it.
It’s who you know. Look, Alec Baldwit is still running loose.

Re “”my plan”. Good advise. Also....
1) Take photographs of the victim, weapon, witnesses, and the scene.
Make sure your camera or tablet is password protected so it cannot be dumped without a warrant.
2) After calling 911 the dispatchers will try to get you to describe the situation....Do not allow the dispatcher to interview you on a recorded phone call.
3) When the police arrive....ask to go to the hospital for evaluation before anything else; after all, you are in shock. Just say “I acted in self-defense.” “I will swear out a complaint against my attacker.” “I will be glad to talk to you after I have consulted my attorney.”
Cops will seem friendly, asking all kinds of questions, that seem as though they are sympathetic to your cause. They aren’t. They outage to get evidence, and they aren’t more fond of one side than the other. Keep that in mind, and respectfully tell them no more info till you speak with a lawyer. Cops have been trained to make people feel as though the cop has their best interest in mind, to put people at ease, make them drop their guard. That is why you need a lawyer there with you when answering. A good lawyer see through the guise.
There may be some cops who truly are sympathetic, and do want to help, but it’s better to assume that they don’t than to be mistaken and sorry later.
Yes, always.
Yes, worth getting insurance if you carry in bad areas prone to attacks etc.
