They did not arrest the crazy homeless guy after he flashed reporters outside the courthouse where the Maxwell trial is taming place. So he had to find another way to get himself into a nice warm jail cell. It’s getting cold out there!

If they had arrested him for indecent exposure, the Christmas tree would still be there.

You're description of this guy's plight sounds familiar. O. Henry wrote a short story about a man in a similar predicament in a more innocent time.
