Thanks for that. Those tweets point to a National Law Review article of 11/14/2021

National Law Review links to the 5th’s document of 11/12/2021 as the source but that still is a temporary stay.

I don’t see anything from the 5th from yesterday or today where any further action was taken.

I agree; thank you for ending up at the same place I did.

My current understanding of status is:

1) Pedo submitted a request for the 5th to reconsider its stay and was denied. Apparently that sets forth an alternate path through other circuits for the DS to try and get another opinion, ultimately leading to the SCOTUS. There was supposed to be a lottery today where they could pick which circuit would hear next.

2) The 5th Circuit affirmed stay based on statutory reasons and the duplicitous + overbroad “mandate” ... they are going to review the constitutional issues and, then, determine whether to issue a permanent injunction, as sought by the petitioners led by the State of Texas ... it appeared this is what was being referred today but it’s still a pending matter.
