Who is responsible for conditions in the DC jail ?
Is it privately run by a corporation, or is it a Federal facility ?
Or is the D.C. jail operated under to Dept. of Justice, or, under Congress ?
Are employees Federal employees ?
Constitutional lawyers want to know, so that they know whom to sue in civil court !
I'd say it's the City of Washington's responsibility to oversee the running of their jails, and there are probably Federal health and safety guidelines/standards that must be adhered to, especially if they get Federal funds. When I worked in NY State's prison system, city and county jails were for those awaiting trial, and those whose sentence were a year or less. Anyone who had been sentenced for more than year, had to be removed from the jail holding them, within a certain number of days, or the State or Federal agency that was supposed to take custody, would be fined X amount of dollars a day, for each day they went over the date that custody was supposed to occur.
