Well, it looks like this group (Liberty Counsel) had one of their lawsuits in Maine denied without comment by the 1st Circuit Court of Appeals.

Appeals court refuses to stop Janet Mills’ vaccine mandate.

That's probably going to be the way it's done across the board -- just refuse to hear the case because the merits of the case are clear in the plain text of the US Code. By refusing the hear the case, they don't have to rule on it against the Biden administration.
