In most states, most misdemeanors have to be cited and released “as soon as practicable”. In California, you would ordinarily not even transport the suspect to jail unless you couldn’t get a positive ID on the guy. You would just cite him out in the field and send him on his way.

Nope. I’ve read the indictment report and more importantly I’ve seen the photos and he was in fact on Capitol grounds well inside the police perimeter that was illegally breached by him (on the east side steps) and others and saw stills off footage of him being pushed back by Law Enforcement and resisting orders. This publicity-focused dude (ran for Congress) was in full military battle gear, treating this as a military operation from the transcripts of his SNS activity. Just a peaceful tourist? Sorry.
