Unless they are Snowden smart and have a good working knowledge of such things, they will make a mistake. All it takes is one small mistake. Finding such phones is a well-developed field...especially when you become flavor of the month.
Seems to me that the Feds caught a few Muzzies buying those ten dollar burner phones by the box a few years back. They’re a one-and-done. Activate it, make a call, and throw it into a lake. They make great cheap detonators for IEDs - wire them to blow up a roadside bomb with a single call to it.

With the exception that the first they have probable cause to get an arrest warrant, with the second they are probably a little short of PC.
Or maybe a better way to explain it, in the first case they are ready to take their case to a jury, in the second they lack sufficient evidence to answer to the suspect’s right to a speedy trial.
But you are right, in both cases they are suspects, but the police use the second term to mediate our sensationalist media. If they called him a suspect they would have to mitigate the media expectation for prosecution, when they are short evidence.
