Your perception is incorrect. Most businesses will license the state for the use of their software under typical contracts.
I think a lot of times the vendor owns the source code, but agrees to put the source code in Escrow if needed in the future for some reason. At least my company had to escrow our source code with several public institutions over the years.
Voting machine software must be open-source capable of being examined before the election, monitored during the election, and examined after the election.
The software must register ONE MAN ONE VOTE. No fractional or weighted counting.
No voting machine should be hardwired or wifi-enabled to connect to any outside system.
Adjudication must be done with poll watchers of both parties pesent and not an unmonitored lone individual in a back room after hours.
Proprietary voting machine software amounts to a secret, unmonitored tally of votes by an unaccountable third party. "It doesn't matter how people vote. What matters is who counts the votes"
Until we use open-source software that can be examined by qualified inspectors the result of every election remain suspect.
It depends on the contract. If the contract is for “voting system” then the company owns the source code. If the contract is for “Program to tabulate votes” then the state owns the source code.
However, in some cases there may be requirements to hold source code in escrow or allow for government (NOT public) security audits etc.

It really all depends on the contract. Typically though, the writer/developer will keep the copywrite and license it out. Sometimes though, the purchaser will pay a premium for outright ownership and then maintain a service rider with the originator.
The certified source code is also held in escrow with a third party, should a State or Court authorize someone to examine it. For example, California had experts examine the election source code before certifying it.
What I mean by "salting coefficients" looks like this. Let's say before election day you tell it to multiply every Biden vote by 1.1 and every Trump vote by 0.9. That would basically add 10% to Biden's vote totals and remove 10% from Trump's vote totals. Thus, Trump would have to win more than 20% of the real votes in your state to barely win the bogus totals reported as "official" counts.
Dr. Shiva was all about this problem long before Mike Lindell became known for more than just being the My Pillow guy.
Ban all these machines. Go back to a non computer system where the election board has complete control of the entire process. No black boxes. That is the only thing that makes any sense at all.
Having “black boxes” in elections should be criminal. This is everyone’s last chance to wake up.
Companies that make open source software solutions make their money on support contracts and training. It can be a very profitable business model to give away the software and make money on support and training.
I worked for a large open source company for a while and we had over 150 developers writing software, all of which went into the public domain.
The ONLY way that we can really trust election systems is via turning them into Open Source projects.
No contract should include the use of proprietary software.
The use of proprietary software should be outlawed.

It’s not rocket science. An honest system — a system which is CLEARLY honest — isn’t that hard to put together. Some federal agency (HA!) or a state (Florida?) or a company (Tesla?) should prototype this and offer to mass produce clean voting stations for every precinct in the country at a reasonable cost.
Any precinct that waves that off and says, “No thanks” is probably dirty and should face the wrath of the voters.
Unfortunately this sort of thing has fallen flat in other areas of the law. For instance, several courts have declined appeals for DUIs on the grounds that the breathalyzer manufacturers are not obligated to divulge the source code for their field devices.
They’re really is no need to ask these questions.
The truth is reality.
The dnc made sure to steal the election. At midnight key polls told some people to leave while false ballots were brought in. Every vote went to the cheater.
Those who could have spotted and stopped this cheat did not.
Reality happened before our very eyes.
The new government immediately vilified anyone who saw that reality, including our rightful president.
Then they passed laws to ensure the steal was permanent.
Saddam Hussein did this same thing, and did the same reason.
Without violence none of this will ever change. When violence does occur, we will be learning a new map.
De Facto, America is gone. Three experiment is over. The constitution had been gutted in every way. Our rights add civilians are gone, and only God’s given rights will remain for each of us to defend on our own.

They bought the machine. Any code needed to run it is proprietary and the manufacturer owns it. You buy your car. You don’t own the code that makes the electronics run.

If so what is the licensing terms and conditions of the open-source part?
Normally the Gov does if they paid for its development. Now if they paid for its development and gave up those rights the government doesn’t. Something I’ve seen happen more then sanely should. It just means the Gov wrote a stupid likely corrupt acquisition contract.And the contractor laughs all the way to the bank.
