No, judge. They are all illegal immigrants unless they used proper channels before they arrived at the border. After they are released they are still illegals.

This “judge” is absolutely wrong. These illegal aliens have been apprehended and processed for an immigration hearing. This does not convey any type of legal status. Chances are they’ll never appear at their hearing so they will forever be illegal aliens and subject to removal from the US.

Judge, the law says the opposite and DHS has no legal authority to admit illegal aliens who fail to appear at a port of entry for inspection and who lack legal documentation permitting such entry.

The US congress never authorized this. DHS is breaking the law and you judge should ask for your money back from whatever law school spawned you.
