By law, all patents relating to nuclear processes are owned by the US Government unless things have changed.

Once there is actual proof of the nuclear process, it will be interesting to see how this all shakes out.

That was actually one of the risks of cold fusion research back in the day - as soon as you succeeded, the government could come in and assert ownership to your IP

Good point. But apparently the USG sees commercialization as a "good thing", as both NASA and the USNavy has and is doing and publishing research and obtaining patents themselves.
