Let's say all 19 deaths are in the elderly and 75% of the vaccinated group are elderly, this means the IFR in the elderly vaccinated is now 19/7008 = 0.3% with RR now 2.31 and p<0.01

It's not what the constitution says. its what the constitution is. The constitution is a contract between the states. If entered into fraudulently then criminal law applies.
