I've stated from the start of this mess, that people need to be put in Gitmo for treason. Those guilty of conspiracy with foreign governments engaged in biological warfare to rig the elections are guilty of treason. The death penalty is the statutory punishment for treason upon conviction. Then charge them with treason, try them in U.S. federal court, and convict them. Summarily rounding them up and shipping them to Gitmo is unconstitutional.

Not if habeas corpus is suspended. Lincoln did it and he is on Mt. Rushmore, the $5 bill and the penny. No one has a constitutional right to be tried in a U.S. District Court. The conspirators hung for assassinating Lincoln were convicted by a military commission without a jury. Strike out a common law jury, and there is no constitutional problem with military courts trying treason cases.
