While I’m not sure as to the technical aspect of it being ‘hearsay,’ I would not automatically assume he’s being honest.
There’s a lot of money now riding on potential lawsuits.
Then again, if my mom were living in a building and creaking sounds woke her up, I would be DIALING THE BUILDING MANAGER as soon as my mom were off the phone.

Ok, I didn’t think in a time of grief a son would act in such a way, but maybe that’s just because I wouldn’t :( Hopefully he is being truthful.
The question is usually whether it falls under any of the standard exceptions to the hearsay rule...
