The Constitution refers to the Supreme Court, which means that it has full and final judicial authority, with the action of quo warranto available at the time of the founding as a means to challenge and remove an official holding office illegally. The same action or its statutory equivalent continue to be available in all fifty states. A federal action for quo warranto is also recognized today.
