He stays out of prison because he makes it a point to understand the law.
That is key, IMO. I have always assumed his team knows the laws for recording conversations in every state he operates in, and he goes by the book. After he gets recordings and video, I believe they closely examine the circumstances, who was there, who knew who was there, what the state laws are, and if they aren’t in compliance, they don’t use that material.
He can’t be taken to court. He won’t lose, assuming the courts actually uphold the law.
And I think they know it.
