Don’t you have to claim ACTUAL damage to file a suit, not “prospective damage”? I’m not a lawyer, but I’m pretty certain you cannot preemptively sue for something that might someday befall you in the future.

If the Oil companies had any real men as CEO’s, the kind that actually gives a damn, the very day the lawsuit was filed they would have STOPPED ALL SALES to EVERY STATE involved. 30 days of Freezing and Starving to Death to Stop Global Warming would do the trick just fine.
