Let’s look at the one of those two cases that “gave a liberal win.”

Can you even frame that case as a “left/right” matter at all?

At issue was whether SHOOTING someone constitutes a seizure if they temporarily elude capture after the shooting.

Roberts, Kavanaugh, Breyer, Kagan and Sotomayor said YES. Any application of physical force is a seizure.

Gorsuch, Thomas and Alito said “No” you have to actually take possession of the person before they are seized.

SO which is the “liberal” view here?
