Democrats consider using 14th Amendment ‘insurrection’ clause to bar Trump from office

Democrats in the U.S. Senate are publicly speculating on whether or not they can utilize the 14th Amendment to the U.S. Constitution to bar former President Trump from ever holding public office again.

The 14th Amendment, passed in the wake of the Civil War, in part directs that no individual may hold any public office in the country if he or she “shall have engaged in insurrection or rebellion” against the U.S. after taking an oath of office in support of the Constitution.

Democrats in Congress have claimed that President Trump’s fiery rhetoric at a Jan. 6 rally in Washington should be deemed “incitement” of insurrection due to a mob of individuals having stormed the U.S. Capitol following that speech.

“It’s an idea that’s out there that I think people are contemplating in the accountability space,” U.S. Sen. Tim Kaine told the Hill on Friday.

“The remedies of the 14th Amendment certainly may be appropriate for someone who incites an insurrection as Donald Trump did,” Sen. Richard Blumenthal said, while Sen. Chris Murphy called the measure "certainly a possibility.”

Legal experts have argued that, under First Amendment jurisprudence, it’s unlikely that Trump actually “incited” the Jan. 6 rioters, given the high bar the Supreme Court has set to meet that standard.

The reason that the Democrats are publicly saying that they can use the 14th amendment is that they know they aren’t getting the 67 senators to vote to convict Trump.

Tactically a better move. Only needs a majority in the Senate instead of 2/3 and still renders him ineligible for any other office. But since it’s not as emotionally satisfying as impeachment they won’t do it.

Can’t legislatures in Republican-dominated states pass legislation making illegal and punishable the connection of ANY computer used in vote tabulation to any outside computer, for instance by the Internet or related external networks? Since I believe from my own analysis that the problem is not the distraction of “voter fraud” but the real problem of “vote tabulation fraud”, this should help.

How can a President incite an insurrection against the government he leads? Makes no sense. I realize that won’t slow dems down.

And if his rhetoric was so ‘fiery’, how come the fiery parts are never quoted?

Seriously, if he had said something like, “March into Congress and show them who’s really in charge of this country!” or “Put the fear of God into them right now”, or say, “’I want you to argue with them and get in their face’ wouldn’t the dems and the MSM be playing the damning quotes even now?

What do you do with democRATs who have taken an oath to uphold the Constitution, but they try to impose communism instead?

The oaths that all politicians take should be abolished. Why should they play games with words when the words don't mean anything? If a politician swears to uphold the Constitution and does not by doing unconstitutional things he/she is never held to account! Can't be held to account. The only recourse is to vote the bums out of office. Why have the oath?
