"The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President" - Article II Sec 1 US Constitution

Which part of that did Mike Pence fail to do? Did he fail to open all the certificates? Or did he fail to count the votes therein? Because he has zero authority under the United States Constitution to do anything else besides open the certificates and count the votes therein.

The states choose their electors by whatever means they see fit. They can do it by lottery or raffle tickets or arm wrestling contest or they can pick names out of hat. They can have a baking contest to choose their electors. Technically, the state could randomly kidnap people off the street and force them to fight on American Gladiators to choose their electors. There's nothing stopping them. The vice president has no authority to do a thing about it. He opens certificates sent by the states and he counts votes. That's it.
