No, no, no, a thousand times no. Pence has no authority to do anything but preside and count. Congress itself has no authority to change anything.

The states have certified their electors and there isn’t a single disputed slate in a single state that has been sent that would need Congressional involvement at all, both constitutionally and statutorily. Everything that happens today is ceremonial and ministerial.

What started with some legitimate questions about state legislative election authority vis-a-vis other state actors has descended into dark farce and lies, bordering on sedition. Once the state legislators decided they were ok with the voters’ choice of electors and didn’t defend whatever prerogatives they felt may have been traduced, that was it.

The idea that a single person, the Vice President, has the authority to intervene in an election in the 50 states is preposterous heading toward insane. Could anyone imagine Biden in January 2017 stepping in and trying to overturn Trump’s win and installing Hillary? Ridiculous on every level.

Pence can refuse to preside and count. I think that was what Chuck Grassley was alluding to when he said he may preside over the counting if Pence “wasn’t available or had to leave suddenly”. The threat to the capitol building might have been another reason why Pence “might not be there”!

It may or may not mean anything constitutionally if the VP simply refuses to show up but it least Pence doesn’t have to put his name onto the documents for a fraudulent election.

Hard to imagine anyone doing what is being suggested that Pence do. If anyone would have done it, it would have been Gore in 2000. Even de-certifying the smallest state (by elector count) that GWB won in that election would have denied him an outright electoral win. He still might have won in the House, but it would have gummed up the works and given the Gore 'Rats time to strong-arm House members.


Remember, think long term. The 'Rats have been sowing the seeds for precisely this kind of outcome for a long time. They've done it with things like motor voters laws, no voter signature verification, no ID requirement, mail-in voting, and early voting options. All of those are controlled at the state level, and all are ripe for fraud. That's where the real battles were fought, and we lost.
