NEW: Iowa Sen. Charles E. Grassley, the Senate president pro tempore, says he and not Vice President Mike Pence will preside over the certification of Electoral College votes, since "we don't expect him to be there."

Grassley said he will listen to debate and that "it would be really wrong for me to say I have my mind made up."

Grassley's office clarifies that he was meaning to explain what would happen if Pence had to step away during Wednesday's proceedings to count Electoral College votes. "Every indication we have is that the vice president will be there," Grassley's office said.

What excuse would there be for Pence being a “no show”

Regardless of who presides, there is only one possible outcome tomorrow. No legal path exists for any other outcome, and none has existed since Nov 3. There are no other electors other than those that add up to Biden being president.

Can you blame them? Politicians lie all the time. And far too often a “clarification” is made not to actually clarify things, but to muddy the waters even more.

The rules that matter are: the Constitution.

The Constitution makes the VP, who is the President of the Senate, the SOLE AUTHORITY with Article Two POWER to conduct the election. The Senate has no Article One (or any other) power to do so, so what the Senators say doesn’t matter. What the President of the Senate says is all that matters.

If Pence opts to run the event under the Senate’s Rules, he’s free to do that. But, he doesn’t have to, and neither can the Senate’s Rules, nor any law passed by Congress, pretend to bind him... as his power is directed, plenary, narrowly focused, unique, and stated directly in the Constitution, Article TWO... which grants no authority to any other but the President, the Executive Branch, and those acting as the Executive in unique, specified circumstances.

The VP will conduct the election however he wants, and that includes that the VP will determine who runs the process in the event that he “steps away”... as it is his power alone to delegate.

If the VP decides that will be Grassley, then it will be. If the Senate’s Rules say it will be Grassley, then it will be, only as long as the VP opts to accept that. That the VP can accept the Senate’s rules... doesn’t REQUIRE him to do that.

And, while a change in the law adopted now wouldn’t matter even if they did try to pass a law over-riding the PLENARY POWER of the Executive, there is nothing in law now that I am aware of which even pretends it contradicts that.

Any change in law attempted now, would not apply to the current election anyway, but only future elections, given the unconstitutionality of ex post facto law. You can’t change the rules in the middle of an election, just because you don’t like how things are going as the election approaches... an issue that is already ripe for adjudication in the current election... on this, as well as on other grounds.

Yup.

No one is coming to save us.

"President Biden" will be installed on January 20 and no doubt replaced by "President Harris" within twelve months as Biden's dementia progresses to some critical level that cannot be concealed. We have a long, nasty glide path down to an American version of Venezuela ahead of us.

Keep lists and work quietly in the shadows. Local! Local! Local! Public protests, armed or otherwise are not an effective way to go.

"Politics is downstream from culture" as said by Andrew Breitbart. The rot in our political system started in the schools, the entertainment media, and financial institutions. Withdraw support and avoid them whenever possible.

Pay attention to what your neighbors and local politicians are doing. You may find that you will need to "do unto others - before they do unto you". Forget about legal arguments; they just don't matter except as a means of distracting and confusing opponents. We are living under Pretense-of-Law, but the authorities will do whatever they can get away with. Time for the rest of us to play by the same "rules".

Best to have plans for surviving the crash and building something out of the pieces afterwards.

Perhaps instructive to note that the New York Times, while still primarily structured around and largely filled with obvious propaganda, lets a few things slip between the lines in the bias... exposing more than intended, perhaps.

Wrong, of course, to posture the “choice” as saying if Pence sides with Trump’s objections to the Executive validating frauds and the products of frauds, that doing so violates the Constitution... which is obvious error.

The Times continues its propaganda effort in pretending there is no proof of endemic, systemic election fraud.

Being deliberately wrong about the wrong... makes them deliberately wrong about the right.

And, they’re shameless: “when Congress convenes to ratify Joe Biden’s victory.” That obviously has no more validity than if they had said, with precisely equal validity: “when Congress convenes to ratify Donald Trump’s victory”.

But, why would they lie about other things ? Like the plans Pence HAD announced, now cancelled, apparently, in which after the election he was expected to visit Israel, the UAE and POLAND... which they now report as not POLAND, but Belgium ?

What does that mean ?
