Hmm. It was always my understanding that he already had that authority, and that the lawsuit was making assertions that weren’t needed because they were already in the Constitution. I’ve also read elsewhere that Pence’s people were saying that he should never have been the defendant in the first place.
We’ll see what happens on Jan. 6. No matter what Pence in tends to do or not do, I don’t think he would telegraph it ahead of time. It’s not smart to do so.
On another note, I’ve read that his trip to Israel, originally planned for right after the Jan. 6 proceeding, has been cancelled. Can any Freepers flesh that out a little?
According to the straight wording of the Constitution, Pence has the power. According to later established law, he doesn’t. The Gohmert suit was filed to get clarification.
