Each State gets one vote (decided by their delegations, which States have more Republican dominated delegations than demonrats). Win.

Both chambers would have to agree in order to uphold a challenge. If only one chamber votes in favor, the challenge is dismissed. Also, as several Republican Senators like Romney and others will very likely vote with the Democrats, it’s likely both chambers will vote nay on any challenge.

Who appoints the delegates? Are they the senior house leaders from each state or does each state legislature send a delegate?
The Electoral Count Act, which this suit challenges as unconstitutional, but has not previously been challenged for 150 years or so, provides that, unless both houses agree, the electoral votes certified by the state's Governor will be the ones counted.
