Just about every regulatory agency I have dealt with in my adult life, including the local game warden and dog catcher (no sarcasm). The agencies have almost unlimited powers to do something. It may be overturned, but they can flat out change the interpretation on a moments notice. That is why consent decrees are so anal. You make everything spelled out so when you get a challenge, you might have a chance to fight it.
