Good point, you might be right.
Like you, I am still skeptical. I can see them having a loud, passionate argument about taking the case / not taking the case. But I don’t see Kavanaugh leaving with a big smile on his face. That part strikes me as wrong. But in the end, the only justices who seemed open to taking the case were Thomas and Alito.
The whole thing is like a political “hot potato”. Between the state legislatures and the courts, they have a lot of power, but they are looking for some kind of political cover before they will take action.
Something big needs to happen. I am hoping the rumor about Ruby (or Ruby’s daughter) talking are true. She could blow the whole thing open.
It does seem a little hard to believe that that kind of dynamic exists in the Supreme Court (i.e. “Don’t forget your role”, “I will tell you how to vote”). Robert’s authority over the other Justices is minimal. The only way that such talk would carry any weight with the other justices is if they’re all under threat and/or compromised, and they all know it. I would have been suspicious that Roberts would even talk to people that way. He always struck me as a milquetoast. But maybe I need to rethink that in light of Lin Wood’s leak of the telephone call (which, to be fair, may not be true).
