it COULD be that “we” (who, exactly?) has the servers
but
they were in a foreign country and presumably their operators would not willingly just give them away
so ...

they probably had to be taken by force.

the article mentions that the ‘US Miliary” took the servers.
that would be force but... it is seriously doubtful that the US Military would seize some private property of somebody in Germany

at least not without German government cooperation (there’s no conceivable way this private attorney could obtain that) and
there’s no way that any private property was seized by the US Military in Germany without it creating a major public incident, with leftist media all over the story

Thus, these reports do not seem to quite add up?

Think clandestine special operators (SEAL's, Delta Force, CIA). With our SOFA with Germany, it's in the realm of possibility.
