When they are a kind of "contract support security" organization, no issues. But if they have morphed into an offensive organization for direct combat, that's wildly unconstitutional and an uncontrolled entity.

If you value freedom, it's a very bad idea to have a wildcat civilian force.

Syria comes to mind immediately here. It would be no surprise at all to learn the CIA had been conducting offensive ops without WH approval there.
