Not a criminal issue. It’s civil. Read up on the difference. By ignoring the criminal law they have caused damages. Damages are corrected by civil suits. OJ although he wasn’t convicted of criminal case was convicted of civil (wrongful death etc). The level of proof is less in civil case.
I think it all very confusing!
I expect many lawsuits to be filed this week, because it takes that long to gather admissable evidence.
But, anyway, since the most likely method of relief is for state legislatures to submit slates of electors, the deciding “standard of proof” will be what convinces a state legislator that his constituents’ votes are not fairly/lawfully reflected by the state’s Executives slate.
I guess that will vary, but be a very high standard.
