I am of the opinion that every state governer needs to have some emergency powers -however- after a short period of time, those powers need to EXPIRE AUTOMATICALLY, unless the legislature passes a majority resolution authorizing the extension of those powers.

There should also be a limit on the number of those extensions. If not a limit on the number of extensions, then increase the percentage required to pass the extension.

Exactly. An emergency is for a hurricane evacuation order or a riot. Done in a few hours or days. Not six months

I am thrilled with the Michigan Supreme Court ruling as I live here. Bizarrely, there are two laws that gave the Governor the ability to declare a State of Emergency. The 1945 law had no legislative oversight requirement. Then another law (Emergency Management Act) was passed in 1976 that did provide for legislative oversight every 28 days for renewal of the SOE. The 1976 law did not replace the 1945 law. It specifically acknowledged the 1945 law and said nothing in the 1976 act was intended to negate the powers of the Governor specified in the 1945 law. Dumb, but don’t tell anybody as we don’t need two stinking laws to abuse us any worse than has already happened.

Michigan My Michigan! Will you stop wearing the Mask of Submission now???
