The Law of Armed Conflict is Federal law, so those prosecuted under it are given due process. Military tribunals are due process proceedings. US civilians either coordinating with a foreign power, or participating peripherally with their own agenda in this ‘war’ are classified as unlawful combatants. They have no right to participate, and can be tried if captured or be killed where found. AKA as unprivileged belligerents they have only basic human rights.
