Executive Order on Increasing Drug Importation to Lower Prices for American Patients

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Section 1Purpose.  Americans spend more per capita on pharmaceutical drugs than residents of any other developed country.  Americans often pay more for the exact same drugs, even when they are produced and shipped from the exact same facilities.

One way to minimize international disparities in price is to increase the trade of prescription drugs between nations with lower prices and those with persistently higher ones.  Over time, reducing trade barriers and increasing the exchange of drugs will likely result in lower prices for the country that is paying more for drugs.  For example, in the European Union, a market characterized by price controls and significant barriers to entry, the parallel trade of drugs has existed for decades and has been estimated to reduce the price of certain drugs by up to 20 percent.  Accordingly, my Administration supports the goal of safe importation of prescription drugs.

Sec. 2.  Permitting the Importation of Safe Prescription Drugs from Other Countries.  The Secretary of Health and Human Services shall, as appropriate and consistent with applicable law, take action to expand safe access to lower-cost imported prescription drugs by:

(a)  facilitating grants to individuals of waivers of the prohibition of importation of prescription drugs, provided such importation poses no additional risk to public safety and results in lower costs to American patients, pursuant to section 804(j)(2) of the Federal Food, Drug, and Cosmetic Act (FDCA), 21 U.S.C. 384(j)(2);

(b)  authorizing the re-importation of insulin products upon a finding by the Secretary that it is required for emergency medical care pursuant to section 801(d) of the FDCA, 21 U.S.C. 381(d); and

(c)  completing the rulemaking process regarding the proposed rule to implement section 804(b) through (h) of the FDCA, 21 U.S.C. 384(b) through (h), to allow importation of certain prescription drugs from Canada.

Sec. 3General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:

(i)   the authority granted by law to an executive department or agency, or the head thereof; or

(ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

(c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Forget drugs, I want an executive order telling the mililtary to start taking out these domestic enemies currently at war with the USA. Now they are blinding cops with lasers, impaling cops with spikes, bashing their heads in with ice bottles?? Are the patriots of this country going to have to take matters into their own hands?

Another reason to get rid of obamacare.

Ok with me as long as they can’t exercise their rights under US Law, if you buy Canada Drugs you should have to sue them there. Their liability protection is included in the drug price.

After recouping their substantial development costs in the US (months/years), the drug companies agree to sell to socialized medicine countries at near production cost. This will result in higher drug prices for people not on Medicare and stifle new drug development. Not a great (socialist) idea.

Despite what you may think about pharmaceutical companies their average net profit margin is 18%...similar to I.T. companies, computer/chip makers, restaurants (not lately, hammered by COVID) and gold/silver mining companies. For “Biotech” drugs (Humira, Remicade, etc.) the news is even worse, a net 0.84% average LOSS for the industry.

If you want to go after companies that are really ripping off the consumer, look at banks/financial (ave. 30% net profit) or railroads at 26.24% net profit.

True. Thank you for your support for the President's executive orders to stop the drug companies from creating monopolies and extorting vulnerable Americans. :)

I could go for that, but it would be a PR nightmare...”you are killing the people of Canada & the UK you evil drug makers!” (By not selling to them at subsidized rates).

They could manufacture 100% in the US but that increases the cost of the drug even further. The cry is “too costly” as it is.

Nice “straw man”...their “monopolies” and “extortion” aren’t working all that well for their profit margins as I mentioned in post #7 above. Cutting-edge drugs cost what they cost, and an 18% net margin isn’t a rip off, it is motivation to develop new drugs. Unfortunately people now view healthcare/drugs as a “right”. The right to any drug at any time whether they can afford it or not. I guess drugs have to have a “Section 8” or “Food Stamp” type government program now in addition to Medicare Part “D”.

That's the socialist way preferred by too many officers of global firms. They like the illusion of consistency for now, want money from big government programs and don't see the dead end just ahead with harder socialism.

Choose that or freer markets, more competition and square deals for Americans. Americans most concerned are those who've spent tens of thousands of dollars or more of their hard earned money, each, on drugs that have been around for a long time.

Yep, we have gone a bit too far down the “government has a hand in every part of the health insurance/drug coverage industry” road to go back to “lower prices via competition” now I guess (I am not named “King” as of yet). ;-) But there are a lot of scare tactics out there too (Bernie half-truths)...like EpiPens....yeah that one private equity CEO person was a jerk, but nobody bothered to check and see that there was another epinephrine (drug has been around forever...delivery methods vary) “pen” manufacturer out there selling for about 1/4 of EpiPen during it’s debacle (”Adrenaclick”).
