Yep. Or until the issue is mooted. Circuit Court is saying it doesn't even have a District Court order to address. "Wait for an order, and appeal that" is one theme playing.
It would be different if the Circuit Court had acted in the case and somehow it's additional action is necessary to allow the District Court to continue. Sullivan is the only court with the ball right now.
