5-311 USE OF NECK RESTRAINTS AND CHOKE HOLDS (10/16/02) (08/17/07) (10/01/10) (04/16/12)

DEFINITIONS I.

Choke Hold: Deadly force option. Defined as applying direct pressure on a person’s trachea or airway (front of the neck), blocking or obstructing the airway (04/16/12)

Neck Restraint: Non-deadly force option. Defined as compressing one or both sides of a person’s neck with an arm or leg, without applying direct pressure to the trachea or airway (front of the neck). Only sworn employees who have received training from the MPD Training Unit are authorized to use neck restraints. The MPD authorizes two types of neck restraints: Conscious Neck Restraint and Unconscious Neck Restraint. (04/16/12)

Conscious Neck Restraint: The subject is placed in a neck restraint with intent to control, and not to render the subject unconscious, by only applying light to moderate pressure. (04/16/12)

Unconscious Neck Restraint: The subject is placed in a neck restraint with the intention of rendering the person unconscious by applying adequate pressure. (04/16/12)

PROCEDURES/REGULATIONS II.

The Conscious Neck Restraint may be used against a subject who is actively resisting. (04/16/12)
The Unconscious Neck Restraint shall only be applied in the following circumstances: (04/16/12)
On a subject who is exhibiting active aggression, or;
For life saving purposes, or;
On a subject who is exhibiting active resistance in order to gain control of the subject; and if lesser attempts at control have been or would likely be ineffective.
Neck restraints shall not be used against subjects who are passively resisting as defined by policy. (04/16/12)
After Care Guidelines (04/16/12)
After a neck restraint or choke hold has been used on a subject, sworn MPD employees shall keep them under close observation until they are released to medical or other law enforcement personnel.
An officer who has used a neck restraint or choke hold shall inform individuals accepting custody of the subject, that the technique was used on the subject.

There is NO justification for keeping lethal force on a restrained person particularly after he. passes out!

I used to handle police brutality cases. It was absolutely wrong for the officer to kneel on the decedent’s neck, because that is bloody dangerous. Here that open and obvious breach of a duty of care was followed by a very predictable death. The manslaughter charges against the cop are fully justified. It wasn’t murder. It was manslaughter.

Speaking of getting killed: do we know the name of the federal police officer shot and killed last night in Oakland. I haven’t heard the name memorialized yet; and can find very little on the murder at all.

Has a reason for the shooting been announced? Have there been arrests? Has the community started protesting his death in the streets?

Has Rev. Crump done an intervention?

“In the carotid sleeper hold, symmetrical force is applied by the forearm and upper arm to the front of the neck such that there is compression of only the carotid arteries and jugular veins and not the trachea. The arm is placed about the neck with the antecubital fossa or crook of the arm centered at the midline of the neck. The free hand grips the wrist of the other arm and pulls it backward, creating a pincher effect. This produces transient cerebral ischemia. The carotid sleeper hold impedes blood flow in the carotid arteries by pressure exerted on both sides of the neck by the pincher effect of the arm and forearm. If properly applied, the compression of the carotid arteries will cause loss of consciousness in approximately 10-15 sec. On relaxation of the hold, cerebral blood flow will be restored and consciousness will return in approximately 10-20 sec, without any serious side effects.”

If you watched the lawyer’s video you would have seen him explain that the knee to the neck technique has NOTHING to do with blocking the airway, and everything to do with blocking the carotid arteries to reduce consciousness. As a result of that, the knee to the neck technique MUST be released if and as soon as the victim has lost consciousness, which was not done in this case.

Don’t be willfully ignorant.

I think they wanted ‘murder charge’ for appearances. Evincing a depraved mind will be hard to prove.

609.195 MURDER IN THE THIRD DEGREE.
(a) Whoever, without intent to effect the death of any person, causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life, is guilty of murder in the third degree and may be sentenced to imprisonment for not more than 25 years.

Then how could he blame the cop and call it murder?

Maybe he died of a massive stroke. Curious people would want to know that before passing judgement.
