Litigation takes years.

Right, but it's the big stick.

Even FCC Rules following the President's EO today are not going to be completed this year.

The other track is legislation. We won't get anything worthwhile unless we first take back the House.

The only immediate TEETH in the Executive Order would be stopping what he says are $billions spent by the Federal Government on these outlaw platforms.

I cannot predict how much or in what way the platforms will change their behavior this year. Do they start to behave; OR, DO THEY DOUBLE DOWN ON DEFEATING THE PRESIDENT (as China has done)????

Maybe some of our FReeQish lawyers can opine as to whether their is a possibility of injunction against their bad acting during the pendency of a judgement and before the election, assuming Barr does begin to litigate on antitrust or other grounds.

They will double down. If Trump loses, all their problems go away and the takeover is complete.

Trump cannot lose.

I’m wondering if the threat of antitrust litigation might be an effective jawboning technique, now that the gauntlet has been thrown down. Sure, it won’t be long before they get some district court judge to issue a national injunction against enforcing anything, but then Trump will have some choices: expedite a legal challenge, or maybe just have Barr announce the opening of antitrust investigation of the entire industry. They’ll have to ask themselves, do they feel lucky? Do they really want to risk a lot of stock valuation on political gamesmanship? It’s easy to say the big money behind them will say it’s worth it, but now at least they’ll be forced to think about the cost of the consequences, up to and including years of litigation and the ultimate break-up up Facebook, Twitter, and the rest.

Meanwhile a legal battle will keep the issue front and center for 2020 and it won’t be easy for the Dems to come out on the side of censorship.
