Anyone know about lawsuits happening in New York related to this nonsense? There should be dozens.

"He added" was to protect himself from bleeding hearts. I'm 70 years young and have been a surfer and ocean swimmer as young as 14. That would be 1964. I've never seen a beach CLOSED! I've seen warning signs about large populations of jelly fish and the occasional warning of contaminated water from runoff from winter storms in the south facing beaches.
Kinda disclaimer: In my youth I surfed, body-boarded, and swam at the SouthBay of Los Angeles (Manhattan, Hermosa, Redondo). Later, I surfed at Huntington Beach, and even later while Navy surfed at Imperial Beach. Now that WAS a hazard due to Tijuana's sewage system. I never caught a damn thing in all that time, other that being stung by a jelly fish once. Ouchy, but no big deal. My life - my risk!
What next? No downhill skiing allowed due to trees? No jogging on public trails due to the occasional mountain lion? No taking your garbage out at night since bears have been sited in back yards? Don't take your car on highways unless you're a professional race track drive? Don't inhale too much air because it may have too much carbon dioxide, even though you exhale carbon dioxide? Never go swimming in a lake or river because dihydrogen monoxide (DHMO) causes more deaths than heart disease. On and on and on and on...
But serious, don't eat the yellow snow.
