He recalled the course of the case :
In 2017, by a decision of the Pechersk District Court as security for the claim (not based on the merits), PrivatBank was obliged to service the deposits of British companies, which, according to media reports, are affiliated with the Surkis brothers. PrivatBank believed that such deposits did not exist because they had been converted into shares of the bank, and therefore the decision was illegal.
PrivatBank appealed the decision of the Pechersk District Court to the appellate court. In the same year, 2017, the appellate court denied the appeal. One of the British companies filed a court ruling with the Internal Affairs Department in the Pechersk district of Kyiv.
Since 2017, the process of enforcement of the court decision has been underway. In fact, how to force to service deposits, which no longer exist and which are converted into shares, to put it mildly, was not entirely clear (neither the performers nor the debtor - "PrivatBank"), - said Malyuska.
The process of "enforcement" was interrupted in 2019 - in early 2020 due to the fact that the executor, at the request of "PrivatBank", asked for clarification to the Pechersk district court on how the decision can be executed, if deposits are already converted into shares.
The Pechersk District Court did not explain anything particularly new, recreating close to the text what was already the case in 2017.
The decision on clarification was upheld by the appellate court.
Then - in 2020, according to the Minister of Justice, the following happened:
"On April 23, the Internal Affairs Department completed the enforcement proceedings (no one transferred the money to either the debt collectors or Surkis).
On April 28, six British debt collection companies (each separately) applied for enforcement of the Pechersk District Court's 2017 ruling.
On April 29, the Pechersk District Internal Affairs Department opened enforcement proceedings and sent a corresponding notice to the debtor, PrivatBank.
And now what do we have? A treason case against Poroshenko developing. I'll be watching developments.
