Not to be a wet blanket because I want to see perp walks as much as anyone, but:
1. They must have committed a crime. Our laws offer lots of wiggle room, from “high crimes and misdemeanors” on down. For example, I think Adam Schiff has committed crimes and could be indicted, but he has also done a lot of stuff that we despise him for but is not illegal. No member of Congress is going to be indicted for “Excessive Investigation” or “Failing To Turn Over Transcripts When Promised” because those things aren’t crimes.
2. There must be sufficient evidence to prove it in court. These people were mostly all lawyers and they knew how to tiptoe right up to the line without crossing it. Or if/when they did, we know their tried their best to cover their tracks or to do so in ways that could easily be explained away as part of their job responsibilities.
3. The higher up in any organization you go, the more wiggle-room they have and the more opportunities to blame others. That’s why company CEOs have to really screw up before they get fired, and then they’re given golden parachutes to keep their mouths shut.
I have confidence that Barr and Durham will look hard to find a way to bring those to justice they can under the law. I trust Barr when he says there must be one standard of justice for all. But I also know these are very slimy, deceptive, and manipulative people who may very well get away with stuff they shouldn’t, not because fancy defence lawyers got them off but because of the three points above.
Hope that doesn’t turn out to be the case.

1. Crimes were definitely committed.
2. They thought they were being sneaky by communicating on game boards and in draft emails. They weren’t. The evidence exists in their own communications.
