In San Diego, a woman who police say organized a weekend protest could face a misdemeanor charge for allegedly encouraging others to violate stay-at-home orders meant to slow the spread of COVID-19.
A police spokesman said the department forwarded the case to the San Diego City Attorneys Office for review on Tuesday. The move comes after some, including civil rights activists, questioned why police did not cite protesters last weekend for ignoring the orders.
A misdemeanor conviction could result in up to six months of jail time and fines of up to $1,000. As of Monday, the City Attorneys Office had not received any cases related to violations of the orders, a spokeswoman said. The office declined to answer questions Wednesday about whether the case had been received or charges had been filed.

If she demands a speedy trial by jury, the charges will be dismissed. Theres no way the courts can empanel. a jury on a non violent misdemeanor. Probably not for the next year. Violent felonies take precedence. With a stay at home order in effect no jury can be empaneled right now.
The police are acting stupidly.
You got to know when to fold em.
And if you get your car stolen in SF, they want you to call 311 rather than file a police report.

Congress didn’t make any law of this kind.
This is wrong.
Where do we see the authority to make these “laws” (which are not “laws”, as they have not been voted on by legislatures)?
Possibly something in the state constitutions that enables emergency powers. If you think about it, there would have to be something like that, for when there is no time to get a legislature to vote on it.
