A Constitution and laws are put in place to keep bureaucrats honest. When they pass arbitrary rulings not based on legal precedents those rulings are basically unenforceable.

Maybe there are rare exceptions: Just as there is no limit to the depths of depravity to which humans can sink, there is also no limit to the heights of goodness and saintliness to which humans can soar. Many soar to great heights every day. Perhaps there are people who are incorruptible.
But most are.
And the incorruptible are those least likely to be attracted to positions of power. President Trump might be one of the rare exceptions. Certainly he has taught his children not to be corrupted by the power of enormous wealth! And he himself shows no evidence of a tendency to abuse power or to be seduced by corruption.
This the greatest fallacy, of many fallacies, in the theories of Karl Marx. He himself acknowledged that an iron-fisted dictatorship would be necessary to establish and implement his policies. Such a dictatorship would inevitably give enormous power to those controlling it, and they would inevitably be corrupted by it. Such an outcome has occurred everywhere his theories have been tried.
Government is run by people--corruptible people. It must be kept as small as possible in order to maintain the control of the governed over it, and the governed must remain eternally vigilant.
