You do understand that this isn’t about actually crossing the border right? Of course they can be searched on entry. This is about them being randomly pulled over within the country as a part of a random sweep process.
So an agent is driving along, sees a bus go by, and decides to search it for no other reason then random sweep. Greyhound wants them to have a warrant.
TSA is a different situation.
1. They do not board and search the plane, and question the passengers while they are locked aboard.
2. TSA screens at fixed, clearly marked points. Providing a citizen with the opportunity and choice to consent or not consent to the search.
An NFL active player got caught in the past week with over 147 pounds of marijuana in his vehicle.
He apparently came across the border near San Diego & then was driving east across Texas. A checkpoint stopped him & the drug sniffing dog alerted on his vehicle.
Multiple duffle bags with all that MJ aboard.
Don’t think he will be playing NFL games this fall.

What about Alcohol Checkpoints? The Supremes deemed them to be legal.

So sanctuary cities isn’t enough, and now we have to have a sanctuary bus line. This is not a ideological decision by Greyhound. It is a business decision to protect Greyhound’s bottom line.
California chose to prohibit ICE from arresting illegals in court houses. This week ICE ignored that insanity and entered a court house and apprehended a wanted illegal and dared the local and state authorities to stop them. Why because federal law supersedes state and local law when there is a conflict according to the Constitution.
TSA has no reason to believe that you are violating any law when you go to an airport to board a flight. Yet they make you submit to a search of your person using pat-downs, X-rays, etc, even completely disrobing if they think it necessary. And Grehound thinks a bus load of illegals should be totally exempt from any search.
All the police or agents have to do is bring in a German Shepherd and have it sit next to or jump on the side of the bus.
No warrant needed.
The FUSA hasn’t followed the Constitution for a long time (over 150 years).

That's what it is leading to. It is just another reason for small government. It's to the point that I rather be among murderers, rapists and hardened criminals than law enforcement. At least you know what your are dealing with and can defend yourself.

TSA is a bad example. They are at fixed, clearly marked checkpoints that a citizen can choose to avoid. Imagine if TSA could pull you over on the road a mile from the airport and search your car with no warrant.
This isn’t about border crossings from what I understand. It’s about them randomly pulling over busses away from the border and searching them “just because”.
Also DUI checkpoints are different because officers are still not allowed to actually search your property unless they have reasonable suspicion that you are committing a crime. If they smell alcohol, that’s enough for reasonable suspicion. If they’re in a bad mood, or have a quota, it is not.
Can they briefly stop a bus? Yes. Can they talk to the driver for a brief amount of time? Yes. Can they board and search the bus and interrogate passengers without a warrant or reasonable suspicion of a crime? No.
Good post. It’s always bothered me that the gov can use a dog bark to attain reasonable suspicion.
